Update on the US Travel Ban

The travel ban that President Donald Trump signed an executive order made it to the headlines all over the world. It became a controversial issue since people think that it is a deliberate way to prevent Muslim from entering the U.S – some people saying that it is a ‘Muslim ban’ but Trump is quick to defend it by saying that it is not like that. His supporters even backed him up with his order that will supposedly ‘make America great again’.

“To be clear, this is not a Muslim ban, as the media is falsely reporting. This is not about religion – this is about terror and keeping our country safe. There are over 40 different countries worldwide that are majority Muslim that is not affected by this order.” – President Trump

To defend the affected people from this order, several judges from different states ordered a stay. Furthermore, several lawyers and translators went to U.S. airports and offered free assistance to help. On the other hand, citizens also went to the airports to protest against the travel ban. It definitely sparked major protests in several cities to fight the executive order.

There are several oppositions to the travel ban order including the Acting Attorney General Sally Yates. In a letter sent to the justice department letter, she stated that she will not support it. Three hours later Yates was fired by Trump and was quickly replaced by drafting in Dana Boente.

“I am responsible for ensuring that the positions we take in court remain consistent with this institution’s solemn obligation to always seek justice and stand for what is right. At present, I am not convinced that the defense of the executive order is consistent with these responsibilities nor am I convinced that the executive order is lawful.”  – Sally Yates

In a statement from the White House press secretary’s office, it stated that Yates was weak in term of illegal immigration and borders. In addition, it also stated “It is time to get serious about protecting our country. Calling for tougher vetting for individuals traveling from seven dangerous places is not extreme. It is reasonable and necessary to protect our country.”

To further oppose the travel ban, U.S. federal appeals court upholds a ruling that suspends it. The court firmly rejected Trump’s attempt to reinstate his executive order. Stephen Miller, a White House adviser, said that the decision was “judicial usurpation of power” and the president’s powers are “beyond question”. The government argued that the president holds a significant power in terms of decisions regarding the national security so the travel ban doesn’t aim to discriminate the Muslims. To counter the order, three appeals court judges said that the government didn’t provide any evidence that any foreigner from the seven affected countries executed any terrorist attack in the U.S.

There are already lawsuits against the ban in 14 states, where Washington and Minnesota argued that the order is “unconstitutional and harmful to their residents, businesses, and universities.” In an interview with ABC, Washington State Attorney General Bob Ferguson said that the government can support the order by asking government officials to testify and examine substantial documents that can back up the main reason for the travel ban.

President Trump has the option of appealing his executive order in the Supreme Court or revising it. However, there are rumors that he is not interested in prolonging the hearing of the first travel ban after the appeals court in San Francisco suspended it. Instead, he is planning to impose another travel ban.

Based on his statements, we can expect that there might be changes in his first travel ban to address the legal issues that arise during the court hearing. In addition, President Trump defended the travel ban saying that it is done in order to protect the country from people who want to do harm. The statements were vague and what we can certainly expect is that there will be another executive order on the way.
